UTAH CODE ANN. § 76-10-1315(4) (2023).

  • Provides that an individual under 18 may not be subjected to delinquency proceedings for prostitution or sexual solicitation.
  • Requires law enforcement officials to conduct an investigation regarding possible human trafficking of the minor, refer the minor to the Division of Child and Family Services, bring the minor to a juvenile receiving center and contact the minor’s parent or guardian, if practicable.
  • Requires that the Division of Child and Family Services provide certain child welfare and other services to the minor.
  • Minors may still be taken into custody and transported to a juvenile receiving center, but they may not be prosecuted.

UTAH CODE ANN. § 76-10-1302(1) (2018).

  • Law enforcement should refer children engaged in prostitution and sexual solicitation to the Division of Child and Family Services. When law enforcement has referred a child, the division shall provide services to the child the child may not be subjected to delinquency proceedings.

  • In determining imminence or reasonableness, the trier of fact may consider any patterns of abuse or violence in the parties’ relationship.

UTAH CODE ANN. § 80-6-1002(1)(a) (2023).

  • Provides for a petition to vacate for certain delinquency adjudications by the juvenile court, if the offense was for a violation of trafficking, aiding prostitution, prostitution or sexual solicitation.

UTAH CODE ANN. § 78B-9-104(h)(ii),(ix) (2023).

  • Provides for post-conviction relief to vacate or modify a conviction or sentence in the event the petitioner committed the crimes of aiding prostitution, prostitution or sexual solicitation arising from trafficking victimization.
