- It is an affirmative defense to prosecution under this section (sex trafficking) that the person engaged in sex trafficking because the person was compelled to do so as described in section 852, subsection 2 (aggravated sex trafficking; person was compelled to do so).
Note that, under Sec. A-1. 5 MRSA §3360-I, Maine has partially decriminalized prostitution.

- A person for whom one or more criminal convictions in which a final judgment has been entered were the result of the person’s sexual exploitation or being subjected to sex trafficking may file a written motion in the underlying criminal proceeding seeking to vacate the conviction and to correct the court records and related criminal justice agency records.
- The same motion may also be filed on behalf of such a person by an attorney for the State or by the court.

- If a person is convicted of a crime and the person engaged in the conduct constituting the crime as a direct result of being a victim of a human trafficking offense as defined in Title 5, section 4701, subsection 1, paragraph C, the person may file a petition seeking a pardon immediately upon the imposition of the sentence, even if an appeal is taken. This section does not apply to a person whose conduct includes the use of deadly force as defined in Title 17-A, section 2, subsection 8, nondeadly force as defined in Title 17-A, section 2, subsection 18 or a dangerous weapon as defined in Title 17-A, section 2, subsection 9, paragraph A.
