MD. CODE ANN., Crim. Law § 1-402(b) (2024).

  • Provides that a minor who is a victim of sex trafficking or human trafficking may not be charged, arrested or prosecuted for certain crimes committed as a direct result of trafficking, such as trespassing, misdemeanor theft, or prostitution.

MD. CODE ANN., CTS. & JUD. PROC. § 10-916 (2024).

  • Repeated physical or psychological abuse by a spouse, former spouse, cohabitant or former cohabitant may be admitted as evidence for the purpose of explaining the defendant’s motive or state of mind, or both, at the time of the alleged offense.

MD. CODE ANN., CRIM. PROC. § 8-302(3) (2023).

  • Provides for a motion to vacate a conviction for prostitution if the defendant proves that participation in the offense was a direct result of being a victim of human trafficking.

MD. CODE ANN., CRIM. PROC. § 10-110 (2023).

  • Provides for expungement of a misdemeanor of prostitution.
  • A petition for expungement may not be filed earlier than 5 years after the person satisfies the sentence(s) imposed for all convictions on which the expungement is requested.
