  • Laws Allowing Expungement/Vacatur

N.D. CENT. CODE § 12.1-41-14 (2023).

  • The North Dakota Uniform Act on Prevention of and Remedies for Human Trafficking, which was codified in N.D. Cent. Code § 12.1- 41, includes a motion to vacate and seal conviction for individuals if convicted of prostitution or similar offense as a direct result of being a victim of trafficking. However, this right only applies to convictions, and according to N.D. Cent. Code § 27-20-33 a disposition or order under the North Dakota Uniform Juvenile Court Act is not considered a conviction of a crime, so this law may not be applicable to juveniles.
